                               THE PEOPLE’S COMMITTEE OF Tây Ninh PROVINCE

  - Based on the law of the Socialist Republic of Vietnam prescribing the functions and authority of provincial people’s committees.

  - Based on Decree No. 234-HL of 14 June 1955 and Resolution No. 29-CP of 11 November 1977 on religious policy from the Central Government Council.

  - Based on the Ordinance on Punishment for Anti-Revolution Crimes of 30 October 1967 from the Central Government.

  - Based on socialist reform policies applicable to agriculture, industry, and real property of the State regarding the southern provinces.

  - Based on Article 3 of the Resolution from the Tây Ninh Province People’s Council from its 6th meeting of the First Session, dated 03 December 1978.

After reviewing inspection reports for 42 religious facilities within and outside of the Tây Ninh Cao Dai Holy See from 21 February 1978 to 8 March 1978 performed by the People’s Committee of Phu Khuong District (now Hoa Thanh) and reports on discovery of reactionary cases within the Tây Ninh Cao Dai Holy See.

Taking into account the legitimate request and aspiration of believers,

To maintain political security and social order; ensure freedom of beliefs; promote collective ownership by the working class; fully protect citizens’ rights and obligations; increase solidarity among all the people to build up our country and defend our socialist fatherland;

                                                   HEREBY DECIDE

ARTICLE 1. To dispose of religious and administrative facilities and assets of the Tây Ninh Cao Dai Church because it violated current law in going against the religious policy of the Socialist Republic of Vietnam, using the following measures:

1. Dissolve and prohibit all activities, no matter in what form, of reactionary organizations and parties originating from the Cao Dai Church or using the name of the Cao Dai Church up to the present time and from here on, both at the central level and local level. Stop and prohibit spiritist seances (see enclosed List No. 1).

2. Dissolve, withdraw management power, and prohibit from now on all activities, no matter in what form, the religious and administrative facilities, both at the central level and local level, including: Hiep Thien Tower, Charitable Projects, Cuu Trung Tower, and Pho Te (see enclosed List No. 2).

3. Confiscate all personnel files, documents, means, instruments, equipment and devices, and assets used for anti-revolution activities (see enclosed document).

4. Prohibit and stop the publication and propagation of information from seances, divine statements and instructions, circulars, religious decrees, religious texts, and sermons tainted with reactionary views opposing Socialism, and harming political security and social order.

5. The people’s government of the commune shall, based on the current views, policies, and law of the State, take possession of, and manage facilities, instruments, equipment and devices, food stores, financial assets, property and real property that should not be under the control of a religious entity, that the Sacerdotal Council must turn over to the State to serve public interests. No one may use the assets identified as belonging to all the people.

ARTICLE 2. Religious facilities of Tây Ninh Cao Dai may continue to be used pursuant to the religious policy of the Socialist Republic of Vietnam:

Within the Holy See:

-/ Holy Temple, Back Hall, Eastern Structure, Western Structure.

-/ Female Buddha Temple, Back of, and Rituals Hall of Báo Ân Từ.

-/ Pope’s Hall.

-/ Hall of the Guardian of Law.

-/ Vegetarian Hall.

A number of units needed for music and rituals serving religious life. About personnel for these, the Governing Council will submit specific proposals to the government, but will not include household registration within the Holy See.

Facilities:

-/ Temple.

-/ Female Buddha Temple.

Each temple and Female Buddha temple should have only between 1 and 3 personnel not of draft age whose task is to attend to rituals for the benefit of believers. They should have the trust of many believers and local notables in order to qualify as implementers of rites.

Citizens who have a religion and those who don’t are Vietnamese citizens with identical obligations and rights, and all must fulfill their civil obligations.

The People’s Committee of the province acknowledges the Governing Council in its current format, positively leaning toward genuine religious life as described in circulars and religious orders issued by the Governing Council.

ARTICLE 3: The Governing Council of the Tây Ninh Cao Dai Chrch is responsible for imparting the understanding of this Decision among all clergy members, functionaries, and believers, and carrying out activities cited in Articles 1 and 2 of this Decision.

ARTICLE 4: Members of the Governing Council, officials in charge of specialized government units, and chairs of people’s committees of districts and towns shall implement this Decision.

This Decision takes effect immediately and shall be implemented within one day.
